These Terms govern your use of the Empire Gym website (www.empiregym.ie) and any membership, day pass or coaching service you buy from us. By using the site, buying a membership, or signing up for coaching, you agree to these Terms.

1. Membership tiers and pricing
Membership grants you access to the Empire Gym floor during opening hours. Prices include VAT.

We may change prices for future renewals on 30 days' notice, your current term is unaffected.
2. Coaching
SS Coaching with Stephen Sharpe and personal training with Dayana are sold separately and have their own onboarding. Coaching plans are built around the information you provide on the onboarding form; they are guidance, not medical advice. If you have a health condition or any doubt about a movement, speak with a qualified medical professional first.
3. Payment
Payment is taken by Stripe Payments Europe Ltd at checkout. By buying, you agree to Stripe's Consumer Terms in addition to ours. We never see or store your full card number.
4. Cancellation and refunds
Monthly and student monthly
You can cancel at any time. Cancellation takes effect at the end of the current billing month; you won't be charged again. The current month is non-refundable once it has begun, because the service has been made available to you (Section 16(1) of the EU Consumer Rights Directive, as transposed by the Consumer Rights Act 2022, Ireland).

The up-front discounted price is paid for the full term. We don't pro-rata refund the unused portion if you cancel mid-term, except where required by law (e.g. permanent medical injury preventing use, with supporting evidence, we'll consider these case by case).
Day pass
Day passes are non-refundable once the day has begun.
Distance-selling cooling-off period
Memberships bought online are technically distance contracts. Under the EU Consumer Rights Directive you'd normally have 14 days to withdraw. By starting your membership immediately (i.e. using the gym, including the day of purchase), you expressly request the service to begin within the cooling-off period and acknowledge that you lose the right to withdraw once the service has been fully performed. If you have not used the gym at all, email us within 14 days and we'll refund in full.
Freezing or pausing your membership
Life happens. If you need to pause your membership because you are travelling or injured, email empiregymcork@outlook.com and we will freeze it for an agreed period rather than you losing the time you have paid for.
- Travel or personal reasons: freeze for up to 3 months in a 12-month period, in whole calendar months, with at least 7 days' notice before your next billing date.
- Injury or medical: freeze for the period your doctor advises, with supporting medical confirmation; we will not count this against your travel-freeze allowance.
- While frozen, billing is paused (rolling plans) or your remaining term is extended by the freeze length (up-front plans). A membership can be unfrozen at any time.
5. Code of conduct on the floor
The Empire code is the way the room runs: strength, discipline, respect. A practical version:
- Respect every other member, no harassment, intimidation, or discrimination on any grounds. We may end your membership without refund for serious or repeated breaches.
- Re-rack your weights and wipe equipment down after use.
- No filming or photographing other members without their consent.
- No drugs, alcohol or arriving under their influence on the floor.
- Listen to staff and any safety instructions; follow signage.
6. Health, safety and disclaimer
You confirm you are medically fit to train. If you have any condition, injury or pregnancy, please tell our coaches before training, and speak to your doctor before starting a new programme. Training, coaching advice, nutrition guidance and use of facilities such as the sauna and ice bath are provided for general fitness purposes and are not medical advice; always work within your own limits.
You use the equipment and facilities at your own risk and agree that, to the extent permitted by Irish law, Empire Gym is not liable for personal injury, illness or loss arising from your use of the facilities, except where caused by our negligence, wilful misconduct, or breach of statutory duty.
7. Memberships are personal
Your membership is for your use only. It can't be transferred or shared. Sharing your access fob or card with anyone else may end your membership without refund.
8. Suspension and termination
We can suspend or end any membership for breach of these Terms or the floor code of conduct. Where the breach is minor and remediable, we'll give you a chance to put it right first.
9. Closures and changes
Hours, equipment and class availability may change with notice. If we close the gym for more than 14 consecutive days for reasons within our control, we'll credit affected members pro-rata.
10. Website use
You may use this site for personal, non-commercial purposes. You can't copy, mirror, or resell our content without permission. We'll do our best to keep the site up but we don't guarantee uninterrupted availability.
11. Liability cap
Where liability cannot be excluded by law, our liability to you for any claim is capped at the total amount you paid us in the 12 months before the claim arose. Nothing in these Terms excludes liability for death, personal injury caused by our negligence, fraud, or any other liability that can't be excluded under Irish law.
12. Changes to these Terms
We may update these Terms. The "Last updated" date above is authoritative. For material changes (price increases, code of conduct changes) we'll notify members by email at least 30 days in advance and give you the option to cancel your current term.
13. Governing law
These Terms are governed by Irish law. Any dispute will be subject to the exclusive jurisdiction of the Irish courts.
